Terms of Sale
Last updated: 3 November 2026
These Terms of Sale set out the agreement between you and the seller when you buy bouquets and gifts on quietroseproject.com. Quiet Rose works differently from most flower shops: you pay when you order, the person you are sending the gift to then decides whether to accept it, and that person alone gives the delivery details. If the gift cannot be delivered for any of the reasons described below, you are refunded in full. Please read these terms before you order and keep a copy for your records. Nothing in them takes away any mandatory consumer right you have under the law of the country where you live.
1. The main points in brief
This summary is offered for convenience. The full terms below contain the detail, and the detail applies if the two ever seem to differ.
- You are buying from a private individual trading as Quiet Rose, and not from a company.
- Prices are in US dollars and include delivery. No delivery or handling charge is added at checkout, and nothing renews.
- You pay by card through Stripe when you order. Your card details never reach us.
- We deliver only in Kyiv, Odesa, Lviv, Kharkiv, Dnipro and Vinnytsia.
- The recipient decides whether to accept. If the recipient declines, or if we cannot deliver, you are refunded in full, including any tip. If the recipient does not answer, the gift stays open and nothing is refunded automatically.
- You will never be shown the recipient’s address or phone number.
- Once paid, an order cannot be cancelled: flowers and food are perishable.
- If an item arrives damaged or is the wrong item, write to us within 48 hours with a photo and we will replace or refund it.
- The mandatory consumer rights of your country remain unaffected.
2. Definitions
The following words have these meanings throughout these terms and the policies that form part of them.
- “Site” means quietroseproject.com in any of its language versions.
- “Buyer” or “you” means the person who places and pays for an order.
- “Recipient” means the person whose first name and email address the buyer enters, and to whom the gift is offered.
- “Order” means one purchase made in a single checkout and identified by an order number.
- “Bouquet” means a hand-arranged flower product listed on the Site as a bouquet.
- “Gift Items” means the chocolates, balloons, candle, vase and handwritten card listed on the Site as additions to a bouquet.
- “Gift” means everything in an order that is to be delivered to the recipient.
- “Private Page” means the page, reached through a private link sent by email, on which the recipient accepts or declines the gift and gives the delivery details.
- “Order Page” means the private order-tracking page that the buyer reaches through a private link.
- “Tip” means the optional amount of 10, 20 or 50 US dollars that a buyer may add at checkout.
- An order “closes” when it has been delivered or refunded.
- “We”, “us” and “our” mean the person trading as Quiet Rose, as set out under “Trading details” below.
3. What these terms cover
These terms apply to every order placed on the Site. The Refund Policy and the Delivery Policy form part of them and give more detail on those subjects. The Acceptable Use and Gifting Policy explains how the gifting service may and may not be used, and Product Information and Allergens describes what you can expect from the products. Your general use of the Site is covered by the Website Terms of Use, and personal data by the Privacy Policy.
Voluntary contributions to the book Quiet Rose are not orders. They are separate from purchases and are covered by the Book Contribution Terms.
You accept these terms by ticking the acceptance box at checkout and completing payment. If you do not agree with them, please do not place an order. Browsing the Site does not commit you to buying anything.
The Site is available in English, Ukrainian and Russian. Translations are provided so that you can read these terms in the language you find easiest. If the versions differ, the English version prevails. That rule does not remove any right that mandatory law may give you.
4. Who may place an order
You must be 18 or over to place an order. By ordering, you confirm that you are, and that you are entitled to use the card you pay with.
The shop is designed for people sending gifts to people they know. Please see the Acceptable Use and Gifting Policy for what that means in practice. You may place an order from anywhere, but the gift itself can only be delivered in the six cities listed in these terms.
5. What we sell
This section describes the products in general terms. Each product page gives the sizes and prices available at that moment.
5.1 Bouquets and gift items
We sell bouquets arranged by hand, together with chocolates, balloons, a candle, a vase and a handwritten card. Gift items can only be bought with at least one bouquet in the same order. They travel with the bouquet and cannot be ordered alone.
5.2 Natural variation and replacements
Flowers are a natural and seasonal product, and two bouquets with the same name will not be identical. Flowers may vary with the season. If a flower is unavailable, it is replaced with one of similar value and style. A replacement of that kind does not change the price and is not in itself a wrong item, but your rights remain in place if what arrives is not of similar value and style or differs materially from what you ordered.
5.3 Images and videos
Images and videos on the Site are illustrative. They may be retouched or digitally created and may show styling ideas, and they are not a record of any particular delivery. Photos show a large size, so a smaller size will look smaller. Vases, chocolates and balloons are sold separately, and they are part of your gift only if you add them to your order.
5.4 Allergens
Chocolates can contain nuts, milk and gluten. Because the gift is for someone else, please think about allergies and other sensitivities before you choose. We cannot promise that any item is free of any allergen. More detail appears in Product Information and Allergens.
5.5 Availability
Products are offered while they are available. If an item in a paid order cannot be supplied or reasonably replaced, we will tell you and refund that item. If the order as a whole cannot be delivered, you are refunded in full, including any tip.
6. How an order is placed
An order passes through the following stages. Nothing is charged until you complete the payment step.
- You choose one or more products, including at least one bouquet.
- You enter the recipient’s first name and email address, a note of up to 400 characters, a sender name of up to 60 characters and your own email address.
- You may add a tip, which is never added by default.
- You may suggest a delivery day, up to 14 days ahead. The recipient sees it and remains free to choose another.
- You accept these terms and the Refund Policy, and you move to a payment page run by Stripe, where you pay by card.
- Once payment is confirmed, we email you a confirmation with a link to your Order Page, and we email the recipient an invitation.
6.1 Order limits
An order can contain up to 10 lines, with a quantity of up to 5 on each line, and cannot exceed 3000 US dollars in total. If you would like to place a larger order, please write to us first.
6.2 When the contract is formed
Placing an order is an offer to buy. A contract between you and us is formed when your payment is confirmed and we accept the order by sending you the confirmation email. If payment is not completed, no contract is formed and the unpaid order record is deleted after about two days.
What we agree to do under that contract is to offer the gift to the recipient and, if the recipient accepts, to deliver it. Delivery therefore depends on a decision that belongs to the recipient. If the recipient declines, neither you nor the recipient is at fault, and you receive a full refund. If the recipient does not answer, the gift stays open and no refund is made automatically.
6.3 Checking what you enter
Please check the recipient’s email address carefully. We send the invitation to the address exactly as you entered it and we cannot verify who controls it. A mistaken address may mean that the invitation reaches a stranger or no one at all. If you notice a mistake, write to us at once with your order number and we will see what can be done. A mistaken address is not a ground for cancelling the order.
6.4 When we may refuse or cancel an order
We may refuse an order, or cancel one before delivery, if we reasonably suspect payment fraud or misuse of the service, if the order breaches the Acceptable Use and Gifting Policy, if the recipient’s address has been blocked from receiving gifts, if a pricing error applies, or if we cannot deliver. Whenever we cancel a paid order, you are refunded in full, including any tip. We do not keep any part of the payment as a penalty.
7. The recipient’s decision
After payment, the recipient receives an invitation email from gifts@quietroseproject.com. It says that a gift is waiting and gives the sender name you entered and a private link. It does not say what the gift is, and it does not give the price or your note.
On the Private Page the recipient accepts or declines the gift. A recipient who accepts gives a name, a phone number, a city from the list, a street, an apartment if there is one, a day from the next day up to 14 days ahead, a time window, and optional instructions for the courier of up to 300 characters.
One reminder is sent after 48 hours. No time limit applies to the answer: the gift stays open until the recipient answers. The recipient owes nothing to anyone, pays nothing, and does not have to give a reason for declining. If the address has been blocked from receiving gifts, no invitation is sent and you are refunded in full.
8. What you will and will not see
The privacy of the recipient is a central part of this service. You will never be shown the recipient’s address or phone number. You are not shown the day the recipient chooses. Once delivery has taken place, we email you to say that the gift has been delivered, without giving the date the recipient chose.
Your Order Page and our emails show the stage the order has reached: invited, accepted or delivered. If the gift does not go ahead, we tell you only that it could not be delivered. We do not tell you whether the recipient declined or whether the address was blocked, and we will not explain further or pass on the recipient’s details, even on request.
Please keep the link to your Order Page private, because anyone who has it can see the page.
9. Prices and charges
All prices are in US dollars and include delivery in the six cities we serve. The amount shown at checkout is the amount you pay: the price of the products and, if you choose one, the tip. We do not add a delivery charge, a service charge or a handling charge, and nothing is payable to us on delivery, by you or by the recipient.
Your bank may show the charge in another currency at a rate of its own, and it may apply its own fees. We do not set those rates or fees and we do not receive them.
9.1 Pricing errors
We try to keep prices and descriptions accurate, but mistakes can happen. If we find an error affecting your order before it is delivered, we will tell you and you may either confirm the order at the correct price or cancel it with a full refund. We will not charge you more than the amount you agreed to pay unless you agree. If an error is so obvious that you could reasonably have recognised it as a mistake, then, to the extent the law allows, we are not bound to sell at that price, and we will refund you.
9.2 Changes to prices
We may change prices on the Site at any time. A change does not affect an order that has already been paid.
10. Payment
Payment is by card only, through Stripe, and is taken in full at the time of ordering. You enter your card details on Stripe’s payment page. They go to Stripe and never reach us.
Each order is a single payment. There is no subscription, no automatic renewal and no later charge against your card for that order.
Your statement will show a name such as QUIET ROSE or QUIETROSE, and the payment page may show the name Quietrose. If you do not recognise a charge, please write to support@quietroseproject.com and we will look into it. You are also free to contact your bank at any time.
If payment fails, or you leave the payment page without paying, the order does not go ahead and the recipient is not contacted. If the amount recorded for a payment does not match the order, we will check the matter before going further and contact you if we need to.
11. Tips
A tip is entirely optional. You may choose 10, 20 or 50 US dollars at checkout, or nothing at all. It is never added by default, and it appears on its own line of your receipt.
If the gift is not delivered, the tip is refunded with the order. Once the gift has been delivered, the tip is not refundable. Adding a tip does not change the products you receive, and the recipient is not told about it.
12. Delivery
We deliver only in Kyiv, Odesa, Lviv, Kharkiv, Dnipro and Vinnytsia, on the day and within the time window chosen by the recipient: 9:00 to 13:00, 13:00 to 17:00 or 17:00 to 20:00, Kyiv time. Couriers pause during air-raid alerts and curfews, and the delivery then moves to the next possible time. The Delivery Policy gives the full detail.
Risk in the gift passes when it is handed over in accordance with the details given by the recipient. Ownership passes to the recipient on delivery. You are not asked to take delivery yourself, and we will not redirect a gift to you or to any other person at your request.
13. If the gift cannot be delivered
You are refunded in full, including any tip, if the recipient declines or if we cannot deliver. You do not need to ask. If the recipient has not answered, nothing is refunded automatically. The refund goes to the original card and usually appears within 5 to 10 business days.
The refund is made in US dollars. Because your bank converts it at the rate that applies on that day, the amount shown in your own currency may differ from the amount shown when you paid. We do not control that difference.
14. Trading details
The shop at quietroseproject.com is run by Maxime Rivière, trading as Quiet Rose. In these terms, “we”, “us” and “our” mean that person, acting under the trading name Quiet Rose, together with anyone acting on that person’s behalf in running the shop.
The seller is a private individual and not a company. There is no company registration number, VAT number or tax number to show on this site, and none should be inferred from the use of a trading name or of the word “we”.
You can reach us at support@quietroseproject.com. We reply within 2 business days. A reply will not always settle the matter on the same day, but you will hear from us within that time.
15. Cancellation, damage and returns
The Refund Policy explains the following commitments in full and forms part of these terms.
15.1 Cancelling
A buyer cannot cancel a paid order. Flowers and food are perishable goods, ordered and made up for one delivery. This does not limit the refunds described in these Terms, if the recipient declines or if we cannot deliver, or any mandatory right you have under the law of your country.
15.2 Damaged or wrong items
If an item arrives damaged or is not what was ordered, write to us within 48 hours of delivery with a photo. We will replace the item or refund it.
15.3 Perishable and non-perishable goods
Flowers and food cannot be returned once delivered. Unused non-perishable items, such as vases and candles, can be returned within 14 days of delivery, and the return is arranged by email.
15.4 Rights to withdraw under the law
The law of some countries gives consumers a right to withdraw from a contract made at a distance, often with exceptions for goods that spoil quickly and for food. If such a right applies to you, you keep it in full, in addition to the commitments above, and you can use it by writing to support@quietroseproject.com.
16. Your responsibilities
When you use the shop, you agree to the following.
- You will give true and accurate information, and you will keep your own email address correct so that we can reach you about the order.
- You will enter only the email address of someone you know, in good faith.
- You will not use the sender name or the note to harass, threaten or impersonate anyone.
- You will not try to find out the recipient’s address, phone number or chosen day through the shop.
- You will respect a decision not to accept a gift, and you will not try to get around it.
16.1 Your note and sender name
You are responsible for what you write in the note and the sender name. The note goes with the gift, so the people who prepare the order will see it. The sender name appears in the invitation exactly as you typed it, and a first name or a nickname is enough, provided it does not suggest that you are someone else. We may decline to reproduce text that breaches the Acceptable Use and Gifting Policy, and in that case we will cancel the order with a full refund if the matter cannot be put right.
17. Events beyond our control
To the extent the law allows, we are not in breach of these terms for a delay or failure caused by an event beyond our reasonable control. Such events include air-raid alerts, curfews, armed conflict and its effects, road closures, power or communications failures, severe weather, shortages of particular flowers, and failures of the third-party services on which the shop relies.
When an event of this kind affects a delivery, we move the delivery to the next possible time. An event beyond our control does not take away your refund: if the gift finally cannot be delivered, you are refunded in full, including any tip.
18. Our responsibility to you
We are responsible for providing what you ordered with reasonable care and skill and for delivering it as described in these terms. If we fail to do so, you have the remedies set out in the Refund Policy and any other remedy the law gives you.
18.1 What is never limited
Nothing in these terms excludes or limits liability for any of the following.
- Fraud or fraudulent misrepresentation.
- Death or personal injury caused by negligence.
- Any other liability that cannot be excluded or limited under the law that applies.
- Your mandatory rights as a consumer.
18.2 Limits that apply to the extent the law allows
To the extent the law allows, and subject to what is never limited, we are not liable for loss that was not reasonably foreseeable when the contract was formed, or for business loss, since the shop sells gifts for personal use.
To the extent the law allows, and subject to what is never limited, our total liability in connection with an order is limited to the amount you paid for that order, including any tip.
We are not responsible for a recipient’s decision to accept or decline a gift, or for what that decision may mean between you and the recipient. You always receive the refund described in these terms if the gift is not delivered.
19. Your mandatory consumer rights
Nothing in these terms removes or limits the mandatory rights given to you by the consumer law of the country where you live. Those rights may concern faulty or misdescribed goods, late delivery, unfair terms and your right to bring proceedings. If any part of these terms conflicts with a mandatory rule that applies to you, the mandatory rule applies.
Time limits in these terms, such as the 48 hours for reporting damage and the 14 days for returning non-perishable items, describe how our own commitments work. They do not shorten any period that the law gives you.
20. Changes to these terms
We may update these terms from time to time, for example because of a change in the law or in how the shop works. The date of the latest version appears on this page.
The version that applies to your order is the one you accepted at checkout, unless the law requires otherwise. An update will not add a charge to an order you have already placed or reduce your rights in respect of it.
21. Changes to the shop
We may change or withdraw products, adjust the cities we serve, or pause or close the shop. Any order already paid at that time will either be carried out as agreed or refunded in full, including any tip.
22. Notices and communications
We communicate with you about your order by email, at the address you gave us. These messages are part of the service: they include your confirmation, the news that the recipient has accepted, the news that the gift has been delivered or could not be delivered, and any refund. They are not marketing. We do not send marketing without your consent, and buying from us does not count as consent.
You may send us any notice under these terms at support@quietroseproject.com. A notice sent by email is treated as received on the day it is sent, or on the next business day if it is sent on a day that is not a business day.
23. Transfer of this agreement
We may transfer our rights and obligations under these terms to another person who takes over the shop, provided that this does not reduce your rights. We will tell you if this affects an order that is still open. You may not transfer your rights under these terms without our agreement, although this does not stop the recipient from enjoying the gift.
24. General terms
The following provisions apply to these terms as a whole.
24.1 Severability
If a court or other competent authority decides that any part of these terms is invalid or unenforceable, the remaining parts continue to apply.
24.2 No waiver
If we do not insist on a term straight away, we have not given up the right to rely on it later. The same is true for you.
24.3 Whole agreement
These terms and the policies that form part of them are the whole agreement between you and us about your order. This does not exclude liability for anything we said fraudulently, and it does not remove any right the law gives you in respect of what was described on the Site.
24.4 The recipient and other third parties
The contract is between you and us. The recipient does not become a party to it by accepting a gift and takes on no obligation under it. Nothing in these terms removes any right the recipient has under the law, including rights over personal data. The commitments made to recipients appear in the Notice to Gift Recipients.
25. Governing law and disputes
These terms are governed by the law of the seller’s place of business. That choice does not deprive you of the protection of the mandatory provisions of the law of the country where you live, and those provisions continue to apply to you where they would otherwise do so.
You may bring proceedings in the courts of the seller’s place of business, or in the courts of the country where you live if the law gives you that right. These terms do not require you to use arbitration. They do not ask you to give up your right to go to court, or your right to take part in any collective proceedings available to you.
We would welcome the chance to put things right first, and the Complaints and Disputes page explains how to raise a problem with us, but you are not required to use that route before taking any other step.
26. How to contact us
For any question about these terms or about an order, please use the contact page or write to Quiet Rose, at support@quietroseproject.com. Please include your order number if you have one. We reply within 2 business days.
